Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. Contract Information

You may only order from this website and therefore enter into a contract with us if you are over 18 years old.

You enter into a contract with us once we have despatched your order and not before.  Until we have despatched your goods your order may not be accepted by us or may be cancelled by you. The duration of the contract lasts from when you order, we take payment and despatch the goods until 14 days after the day after you receive the goods.

It is our responsibility to supply you with goods that meet your consumer rights.  If you have any concerns that we have not met our legal obligations please contact us.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Content”
means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

“Simpson’s of Newmarket”

“Service”
means collectively any online facilities, tools, services or information that Simpson’s of Newmarket makes available through the Web Site either now or in the future;

“System
means any online communications infrastructure that Simpson’s of Newmarket makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

2.1 All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Simpson’s of Newmarket, our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.

2.2 Subject to sub-clause 2.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Simpson’s of Newmarket

2.3 Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

5. Privacy and Personally Identifiable Information (PII)

5.1 Use of the Web Site is also governed by our Privacy Policy which is incorporated into these terms and conditions by this reference. To view the Privacy Policy, please click on the link above.

5.2 We retain and use personal information strickly under the privacy policy.

5.3 Transactional emails (e.g. order confirmation, shipping confirmation) by their very nature will contain Personally Identifiable Information, by placing an order with us you are agreeing to these emails being sent. 

All transactional email (password reset emails, order confirmation emails etc.) that this website sends are sent over the Simple Mail Transfer Protocol (SMTP). This website’s SMTP servers (provided by MailChimp) are protected by TLS (sometimes known as SSL) meaning that the email content is encrypted using SHA-2, 256-bit cryptography before being sent across the internet.

5.4 Like most websites, this site uses Google Analytics (GA) to track user interaction. We use this data to determine the number of people using our site, to better understand how they find and use our web pages and to see their journey through the website.

Although GA records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us. GA also records your computer’s IP address which could be used to personally identify you but Google do not grant us access to this. Google also claim that they anonymise this data meaning that even they cannot personally identifiy you from this data. We consider Google to be a third party data processor.

GA makes use of cookies, details of which can be found on Google’s developer guides. FYI our website uses the analytics.js implementation of GA.

We retain our GA data for 38 months after which time it is automatically deleted.

To prevent GA from tracking your journey through this website we recommend installing the Google Analytics Opt-out Browser Add-on extension for your web browser.

6. Delivery (please also see ‘Delivery and returns’ at the foot of each page)

6.1 We only ship within the UK.

6.2 Delivery for orders of £49 and over is free. Our standard delivery charge for orders of £48.99 and under is £3.95.  Delivery will usually be by Royal mail or courier depending on the size of the order and may require a signature.

6.3 If your order has arrived and is damaged, faulty or incorrect please contact us by email or phone within 48 working hrs of delivery.  We will then discuss the options available to you.

6.4 Under the Consumer Protection Regulations 2013 you have the right to cancel your order up to 14 days from the day after you receive your order.

You must inform us within this period of your intension to cancel either by email, letter, telephone or by filling out the cancellation form.  Once you have informed us you have 14 days to return the product to us. You are responsible for the cost of returning the item. The product must be in an unused, unsoiled condition complete with all tags attached and in the original, undamaged packaging. 

We suggest that you use a signed for/tracked method of return as products remain your responsibility until we have received them.

We will only issue full refunds once we have checked the products and are satisfied that they are in a resalable condition. We will refund the delivery charge if we have received the whole order back. Refunds will be within 14 days of us receiving the returned product by the same payment method used at the time of order.

6.5 Most products have a warranty of one year.  If after a period of use the product develops a fault that is not due to normal wear and tear please contact us to discuss your options.  Sometimes goods will need to be sent back to the manufacturers for testing before replacements can be issued.

The cost of returning items is not covered under warranty and must be paid by yourselves if the product is assessed as faulty then your postage will of course be reimbursed. Repaired/replaced goods will be sent to you free of charge.

7. Disclaimers

7.1 Simpson’s of Newmarket makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service.

7.2 No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.

8. Availability of the Web Site

The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

Simpson’s of Newmarket accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Simpson’s of Newmarket accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

9.2Nothing in these terms and conditions excludes or restricts Simpson’s of Newmarket’s liability for death or personal injury resulting from any negligence or fraud on the part of Simpson’s of Newmarket

9.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

10. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

11. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise

12. Notices

All notices / communications shall be given to us either by post to our Premises (see address above) or by email to sales@simpsonsofnewmarket.co.uk. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

13. Law and Jurisdiction

These terms and conditions and the relationship between you and Simpson’s of Newmarket shall be governed by and construed in accordance with the Law of England and Wales and Simpson’s of Newmarket and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
